RIGHT TO APPEAL

Florida Statute 720.305 (2) (a) A fine or suspension may not be imposed without notice of at least 14 days to the person sought to be fined or suspended and an opportunity for a hearing before a committee of at least three members appointed by the board who are not officers, directors, or employees of the association, or the spouse, parent, child, brother, or sister of an officer, director, or employee. If the committee, by majority vote, does not approve a proposed fine or suspension, it may not be imposed.

COMMITTEE DUTIES

The Fine Appeals Committee is responsible for conducting hearings as needed for members who wish to appeal a fine that has been levied against them. This committee does not determine fines to be levied against members; rather, they rescind or confirm a fine being levied.

The committee shall amongst themselves, appoint a chairperson that will coordinate its actions and act as the single point of contact for that committee. A decision of this committee requires majority consent of the committee members.

The board of directors shall notify this committee when an appeal has been filed. They shall then (with the assistance of the appealing member) determine a time to convene a hearing (not to exceed 30 days from notice of appeal). Results of the hearing shall be given to the board so the fine can either be levied or rescinded.
